Terms of Service
Last Updated: September 14, 2026
1. Introduction
Thank you for choosing Confectionery Canvas, a trade name of Monavaz LLC. These Terms of Service (“Terms”) govern your access to and use of our website (confectionerycanvas.com and associated Sites) and the purchase of our baked goods, custom orders, and confectionery products (the “Products”). For the purposes of these Terms, “Monavaz,” “we,” “us,” or “our” refers to Monavaz LLC, including its subsidiaries, affiliates, directors, officers, employees, and agents.
These Terms contain a mandatory Arbitration Provision and Class Action Waiver that requires the use of arbitration on an individual basis to resolve disputes.
Acceptance & Governing
By placing an order, paying an invoice, or using our Sites, you agree to be bound by these Terms, our Privacy Policy and Cookie Policy, which are incorporated herein by reference. You affirm that you are of legal age to enter into these Terms, or if not, that you have obtained parental or guardian consent. If you have any questions about these Terms of Service, please contact us at help@confectionerycanvas.com.
These Terms shall be governed and construed in accordance with the laws of the State of Ohio. If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
Changes to These Terms
We reserve the right to modify these Terms at any time. Continued use of the Site or placing new orders constitutes acceptance of the updated Terms.
2. Payments & Refunds
At Monavaz, we take immense pride in our artistic process. Because our products are perishable and often involve specialized, long-lead preparations, we adhere to the following payment, cancellation, and refund standards:
Payment Terms
- Advertisements & Coupons All advertisements and coupons are valid at our sole discretion.
- Methods You agree that we will charge your designated payment method. If your primary payment method fails, you authorize us to charge other payment methods on file. We may update your payment information according to information provided by payment networks or financial institutions.
- Payment Full payment is required for all orders unless a deposit schedule is explicitly outlined in a custom quote or invoice. You remain responsible for any unpaid amounts.
Cancellation Tiers
We offer a tiered refund system based on how far in advance you notify us of a cancellation. All cancellation requests must be sent in writing to help@confectionerycanvas.com.
- 7+ Days Before Pickup Cancellations made 7 days or more prior to your scheduled fulfilment date are eligible for a full refund to your original payment method.
- 3 to 6 Days Before Pickup Cancellations made within this window are eligible for 100% store credit. At this stage, specialized ingredients have been prepared, and we have reserved a dedicated production slot for your order.
- Less than 48 Hours Before Pickup Absolutely no refunds, store credits, date changes, or inventory transfers will be issued. Within 48 hours, all frostings, batters, and custom components are finalized.
Fulfilment & Abandoned Orders
- Pickup Pickup orders not collected within twelve (12) hours of the original scheduled pickup time are designated as Abandoned.
- Deliveries All deliveries require an eligible adult recipient to be present at the delivery location during the scheduled delivery window to sign for and receive the order. If no eligible recipient is available during the scheduled window, or if access to the location is restricted, the order is immediately classified as Abandoned.
- Shipping Items eligible for shipping via third-party carriers, we are not responsible for delays, loss, or damage caused by the carrier or due to weather conditions during transit. Damage claims due to packaging errors must be emailed to help@confectionerycanvas.com within 24 hours of delivery with photographic evidence.
- Abandonment Because our products are highly perishable, fresh-baked food items prepared exclusively for scheduled handoffs, all Undeliverable orders are instantly designated as Abandoned upon the driver’s departure.
- Forfeiture & Disposal Abandoned delivery orders are strictly non-refundable, non-returnable, and ineligible for store credits, re-delivery, or late in-store pickup under any circumstances. Ownership of the product immediately reverts to Monavaz, which reserves the right to discard, donate, consume, or resell the items at its sole discretion without compensation to the customer.
3. Orders & Food Safety
- Allergy Notice Our products are prepared in a kitchen that handles nuts, gluten, dairy, and other allergens. It is your responsibility to notify us of any allergies prior to ordering. We cannot guarantee a 100% allergen-free environment.
- Accuracy You are responsible for providing correct pickup/delivery dates and contact information. For custom orders, details must be finalized at the time of deposit.
- Perishability Monavaz is not responsible for damage caused by improper storage, heat, sun exposure, improper transport, or mishandling after the Product leaves our possession.
- Inspection Please inspect your order thoroughly at the time of pickup. Once the product leaves our possession, it is considered Accepted as meeting your specifications for design, size, and flavor.
- No Returns For health and safety reasons, we cannot accept returns of food items.
4. Intellectual Property
- Bakery Ownership Monavaz retains complete ownership of all original design concepts, artwork, photography, custom recipes, and “Confectionery Canvas” branding. You may not use our product photos or proprietary design concepts for commercial purposes without prior written consent.
- Third-Party Trademarks Incorporating third-party intellectual property (including, but not limited to, licensed character rings, branded cupcake toppers, licensed cake figures, or trademarked color palettes) is done solely as a decorative service using legally purchased, off-the-shelf retail components or at the customer’s explicit request. Monavaz does not claim ownership, sponsorship, license, or affiliation with any third-party trademark holders or corporate entities whose characters, logos, or brand elements may appear on retail accessories included with your order. All trademark rights remain the sole property of their respective owners.
- Customer-Provided Content & Indemnification If you request custom designs incorporating specific logos, images, or trademarked elements, you represent and warrant that you possess all necessary rights, licenses, or permissions to use such materials. You agree to indemnify and hold harmless Monavaz from any third-party trademark or copyright infringement claims arising from your requested design elements.
5. Disclaimer of Warranties
Products are provided “as is” and “as available” without warranty of any kind, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. While we strive for aesthetic perfection, slight variations in color, layout, and finish are natural in handcrafted baked goods. We do not warrant that products will meet specific aesthetic expectations beyond the agreed-upon design brief.
6. Limitation of Liability
To the fullest extent permitted by law, Monavaz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or business opportunities, arising from your purchase or use of the Products or Sites. Our total aggregate liability for any direct damages shall not exceed the total amount paid by you for the specific order in question.
This limitation does not apply to death or personal injury caused by our negligence, fraud, or gross negligence.
7. Indemnification
You agree to indemnify and hold harmless Monavaz and its affiliates from any claims, liabilities, expenses, and damages, including attorney’s fees, arising from your use of the Products, your violation of these Terms, or your infringement of any third-party rights, including intellectual property rights related to content you provide to us.
8. Disputes & Arbitration
If any provision of this arbitration clause is found unenforceable, the remaining parts will still apply.
Except for small claims court matters and intellectual property infringement claims, any dispute, controversy, or claim arising out of or relating to these Terms, your order, or your relationship with Monavaz shall be resolved through final and binding individual arbitration.
Class Action Waiver
You agree that any arbitration or proceeding shall be conducted in your individual capacity only and not as a class action, collective action, or representative proceeding. You explicitly waive the right to a jury trial or to participate in a class lawsuit.
